Puffcity Franchise LLC (“Puffcity”, “we”, “us”)

These Terms of Service (“Terms”) govern your use of www.puffcity.com (the “Site”). The Site provides information about Puffcity, our stores, our loyalty program, franchise opportunities, and careers. By using the Site you agree to these Terms and to our Privacy Policy.

1. You must be 21 or older

Puffcity sells age-restricted products. Our Site and stores are intended only for adults who are at least 21 years old. By using the Site you represent that you are 21+. We verify age in our stores as described in our Age Verification Policy, and we refuse any sale where age cannot be verified.

2. The Site does not sell products

This website is informational. Products are sold only in our physical stores; no purchases, payments, or checkout take place on this website. Product descriptions and images shown for information are provided for convenience; packaging, availability, and pricing vary by store and can change at any time without notice.

3. Your use of the Site and any account

If you create a membership or submit information (for example, a job application or an inquiry), the information you provide must be accurate and kept up to date.
You are responsible for keeping any login credentials confidential and for activity under your membership.
We may suspend or remove access used fraudulently, abusively, or in violation of these Terms or the law.

4. Loyalty program

If you join our loyalty program: points have no cash value, cannot be transferred or sold, and may expire or be adjusted in cases of returned purchases or abuse. We may modify or discontinue the program with reasonable notice.

5. Returns

Purchases are made in our stores and are subject to our Return & Refund Policy, which is part of these Terms.

6. Acceptable use

You agree not to: misuse or attempt to disrupt the Site; probe or breach its security; scrape it with automated tools; submit false information (including false age or identity); or infringe others’ rights. We may block access to protect the Site and our customers.

7. Intellectual property

TO THE FULLEST EXTENT PERMITTED BY LAW, PUFFCITY WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, ARISING FROM YOUR USE OF THE SITE.

11. Indemnification

You agree to indemnify Puffcity against claims arising from your violation of these Terms or misuse of the Site, to the extent permitted by law.

12. Governing law and disputes

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Essex County, New Jersey, and you consent to their jurisdiction.

We may update these Terms from time to time. The current version is always at this URL, with its effective date at the top. Changes apply going forward.
